In the following terms and conditions, "the Photographer/Videographer" shall refer to Warren Poole. "The Client(s)" shall be the two individuals getting married in a wedding booking, or the individual(s) that make the booking in the case of any other event. It is agreed that the following terms constitute the total agreement between the parties, and no variation or modification of this contract shall be effective unless agreed to by both parties in writing.
A non-refundable booking fee (as specified in your invoice) is required to secure the time and services of the Photographer/Videographer for your event. This fee is non-refundable and non-transferable in the event of cancellation, as it is a pre-agreed compensation for lost business due to the reservation of your date. By completing payment of the non-refundable booking fee, the Client accepts all the terms and conditions outlined here. The booking fee will be deducted from the total cost of your chosen package. Unless stated otherwise, the remaining balance is due in full one calendar week before the event date.
The details of the wedding arrangements are to be agreed upon beforehand in writing (email is acceptable). The Client shall notify the Photographer/Videographer of any changes to these details in writing. The Photographer/Videographer cannot be held liable for delays or disruption to their services until any changes are received and acknowledged in writing.
The Client may cancel this contract at any time by providing written notice to the Photographer/Videographer. In the event of cancellation, all monies paid are non-refundable. The following cancellation fees will apply:- Cancellation more than one week before the wedding: The booking fee is forfeited. - Cancellation less than one week before the wedding: The full remaining balance becomes immediately due.All cancellations must be submitted in writing.
The Client hereby grants the Photographer/Videographer permission to display any photograph and/or video covered by this contract. This includes, but is not limited to, using them for business promotion and advertising on websites, social media channels, brochures, magazine articles, and sample albums. This permission is granted unless the Client has chosen the option to not allow the display of images for an additional fee.
All image and video sizes are nominal. The Photographer/Videographer will provide a pleasing color balance but cannot guarantee exact color matching due to variations in lighting, dyes, and materials. It is sometimes impossible to digitally record the exact color as seen by the human eye. For a booking involving a church ceremony or at certain venues, the Photographer's/Videographer's movements may be restricted by the official in charge. The area from which the Photographer/Videographer is able to cover the ceremony may not be their choice, and they cannot accept responsibility for any obstructed view should this be the case.
All images and/or video will be adjusted for exposure, brightness, contrast, and sharpness. The Photographer's/Videographer's judgment regarding these corrections and the number of images provided to the Client shall be deemed correct. Final editing is limited to these standard adjustments. Major retouching, digital manipulation, or the use of software like Photoshop to alter physical appearance is not included in the standard package
The Photographer/Videographer shall aim to provide the Client's chosen product, via an online gallery, within thirteen calendar weeks (91 days) of the event date. In the event that this timeline cannot be met due to unforeseen personal or professional circumstances, the Photographer/Videographer will provide written confirmation along with a revised estimated delivery date.The Client understands that no refund or reduction in price will be provided for late delivery of the final product.
The Copyright Designs and Patents Act 1988 assigns the copyright of the images and/or video to the Photographer/Videographer. Any images, copies of images, or computer programs relating to such images are protected by this Act.It is a violation of this Act to copy or allow to be copied, either photographically or electronically, any image and/or video created as part of this contract without the express written permission of the Photographer/Videographer.
The Photographer/Videographer shall be granted artistic licence in relation to the poses photographed/recorded and the locations used. The Photographer's/Videographer's judgment regarding the locations, poses, and number of images taken shall be deemed correct. Due to the unpredictable nature of weather and the willingness of subjects, it may not be possible to capture all the images/video requested.
The due performance of this contract is subject to alteration or cancellation by either party due to any cause beyond their control, including, but not limited to, natural disasters, epidemics, or government restrictions.
While all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the Photographer/Videographer will not be responsible for photographs or video that are not produced due to technical failure of equipment.
In the unlikely event that the assigned Photographer/Videographer is unable to attend your event due to unforeseen circumstances, we reserve the right to appoint another competent and experienced professional to attend on our behalf. We will make every effort to find a replacement with a similar style and quality of work.
In the unlikely event of a total photographic or video failure, or cancellation of this contract by either party, or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
Any directions issued to clients, their guests, or employees during a photographic or video shoot are deemed to be at said persons' own risk. The Photographer/Videographer cannot be held responsible for any personal accidents during a photographic or video shoot.
The Client understands and agrees that laser light, including those used for entertainment or special effects, can cause permanent and irreversible damage to camera sensors. It is the Client's responsibility to ensure that no lasers are used at the event venue. In the event that laser light is used, the Photographer/Videographer reserves the right to cease all photography and videography services immediately to prevent equipment damage. The Client will be held liable for the full cost of repairing or replacing any damaged equipment and will not be entitled to any refund. The full payment for the contract will remain due.
This agreement shall be governed in accordance with the laws of England and Wales.
